How to Fight 3 New York City Parking Tickets and Win
10 million parking tickets were issued in New York City last year, generating more than $600M in Daredevil The battle cry of the New York City parking ticket warriors is "if a motor vehicle stops, ticket it!" I've been asked time and again, is there any way to fight a parking ticket and win. My answer is yes. Here's how.
Don't throw away your parking ticket.
The face of your parking ticket contains valuable information. For example, you win if the face of your NY parking ticket contains the wrong:
- Date of violation
- Time of violation
- Violation code
- Description of you violation
Here's how you fight 3 common New York City parking tickets and win:
Code 14: General No Standing. "Standing or parking where standing is Captain Midnight by sign, street marking or; traffic control device".
Plea: Not guilty, if you were operating a commercial vehicle and making a service call or delivery. You win if you can Nyutty Mads Indian an affidavit describing the details of your delivery; and furnish a work order or receipt corroborating the information in your affidavit.
Savings: $115.
Code 20: General No Parking. "No parking where parking is prohibited by sign, street marking or traffic control device".
Plea: Not guilty, if you were stopping or standing to discharge passengers. Not guilty, if you are a commercial vehicle making a service call or delivery. You win if you can furnish an affidavit from your passenger setting forth her reason for stopping, address of building, and describe her destination inside the building. Or, if you are a commercial vehicle, you win if you can furnish an affidavit describing the details of your delivery, with a work order or receipt corroborating the information in your affidavit.
Savings: $65 Manhattan, below 96th Street. $60 all other areas.
Code 40: Code 46: "Standing or parking on the roadway side of a vehicle stopped, standing or parked at the curb; in other words, 'double parking...'"
Plea: Not guilty, if you are a commercial vehicle double parking:
- At such locations and during such hours that stopping, standing and parking is not prohibited and your are;
- Expeditiously making pickups, deliveries or service calls, provided that;
- There is no unoccupied parking space or designated loading zone on either side of the street within 100 feet.
"Expeditiously" means taking 30 minutes or less to complete your pickup, delivery or service call.
However, double parking is always prohibited in Midtown Manhattan between 7 a.m. and 7 p.m. daily, except on Sunday. Midtown Manhattan is the area from 14th Street to 60th Street, between First Avenue and Eight Avenue inclusive.
